to speak this morning before heading out the number of years. he will spend behind bars. and improving safety around dangerous rail crossings on the peninsula. the request now for bay area leaders. >> from the bay news station. you're watching kron. and news. >> thank you for joining us here on kron. 4 news at noon. i'm justine waltman. we will start with a little deja vu. david pat, back in a federal courtroom to be re-sentenced today. this new hearing coming after the judge in the case failed to ask the pap if you wanted to address the court prior to sentencing kron four's today. justice in court this morning. she's now here in newsroom with what happened. thanks for joining us. right. a week and a half ago, david pat did not have a chance to address a federal court before sentencing. and this morning he did standing with his attorney by his side, a pap, seen apologetic, telling the judge that he has reconnected with family and promising not to be violent. again, saying in court he was influenced by the january 6

capitol riot judge that clean corley stating the sentence needs to reflect the damage and seriousness of the crime. the pat received a total of 50 years. the maximum allowed 20 years for attempting to kidnap nancy pelosi and 30 years for assaulting paul pelosi with a hammer inside their san francisco home. the 44 year-old will now serve his sentence concurrently, meaning the total length he will serve will be 30 years. the paps ex-wife and son not agreeing with the sentencing today. a lifetime sentence. quite harsh, but also white >> the path was also given credit for the 18 months. he's been in custody reporting in the newsroom to be justice kron. 4 news. tiffany, thank you so much. happening tomorrow, scott peterson whose the man convicted of killing his wife and their unborn son

is set to appear in court. his defense team, the los angeles innocence project has been trying to get him a new trial. they want to dna test a rope and a stolen van that was burned right near the peterson's home around the time that laci peterson went missing. the stanislaus county district attorney's office is opposed to this new testing. it says nothing about the evidence has change will be in court for you tomorrow. and right now police are investigating after a woman has been found dead inside of a home in san jose. police say they have a suspect in custody. kron four's will tran in san jose with the latest. >> police officers are still on the scene and we're talking more than 12 hours after they arrived. they actually got here at around 6.30, last night and they're actually corey more officers to the scene as they continue to investigate. let me show you the video at around 8.15, this morning. the coroner's office finally arrived to the home. all this is approximately 12

hours after police officers were able to go inside the home this all started at around 6.30, last night when police officers from the san jose police department. >> they got calls about shots being fired in this neighborhood. 300 block of north 20th street just off julian when they got here, they try deal with the suspect that used to give himself up. instead, he barricaded himself inside the home. police officers obviously did not want to russian for their own safety. instead, they called it go. she 8 ers out talk to the suspect for 5 to 2 and a half hours. then finally at around 8.30, or so the suspect gave himself up without any incident. he has been arrested. his name not be released to the public at this time. that's when they were able to make entry inside the home. and that's when they found the body of a woman inside. reportedly the 2 are

not stranters to each other but their relationship not be released to the public at this particular time. now that the coroner's office has your body, it will be up to the coroner's office to release her name to the public. and of course, it will be up to the san jose police department to find a motive behind us. and so far, no motive has been released. back to you. >> state senator josh backers calling for more attention to dangerous train crossings and the state is asking for crossing improvements and separation projects in the peninsula. kron four's patrols conferred joins us now live from burlingame. he has the details. thanks for joining us. >> well, good afternoon. there is currently a plan to spend about 744 million dollars improving 3 rail crossings to in santa clara county and one here in burlingame, san mateo county at broadway in california. this one particular needs about 70 million dollars in state funding. but at the moment, the california legislature is

set to not provide any money for these projects and now local elected officials are trying to get them to change their minds. here in burlingame, the caltrain crossing at broadway in california drive is one of the most dangerous rail crossings in the state over the years. dozens of vehicles and pedestrians have been hit here with multiple fatalities. the state legislature had allocated 113 million dollars in funding to help pay for improvements. here. >> and 2 other rail crossings, one in palo alto, one, another in mountain view. but that funding was recently pulled from next year's proposed budget. this is a massive problem. we have a chance to fix it. let's not miss that window. state senator josh becker who represents the area is leading the charge to try to get that funding reinstated because that's going to leverage 100 million dollars to both federal funds county and local funds. >> so this is all ready to go. we're ready to break ground next year, but we need the 70 million with the thought of losing funding. it really does put in jeopardy our ability to get the project done. caltrain

executive director michele bouchard says the transit agency supports the proposed safety improvements were operating an all-time high level of train our ridership is coming back. and so we really do need to be able to provide the level of service that the community needs. it's unclear why the funding was pulled from the budget or if governor newsom supports putting it back in. the state legislature has about 2 weeks to decide if that money will be restored. all right, back live. now caltrain is also in the middle of an electrification project to make all the trains along peninsula electric. and that could make trains run faster. more often in quieter, senator becker says that's even more reason to get these intersections improved. but for now bob redwood city, charles clifford kron, 4 charles, thank you so much. >> a driver is dead after a car got pinned underneath the truck. this happened yesterday afternoon in san jose and the

corner of montague expressway to avenue the cause under investigation. but people who work near this intersection say they have seen drivers here travel very fast and recklessly. >> i know that this is 3 they saw very dangerous because usually walk to catch another bus when there's no route here and i feel kind of and save, you know what i'm doing to cross road. so cars are coming really fast. >> police do tell us they plan to offer some more details on what happened here later on today. when we get those details, we'll pass them on to you. happening right now. newark police are looking for a teenager who was reported missing yesterday. police are searching for 14 year-old dunbar. look, he is 5 foot, 8 ways 130 pounds. police say he was seen wearing a gray t-shirt, blue gym shorts, gray sox and blue running shoes. if you happen to know this teenager is you should call police. we'll talk about our

weather forecast now looking outside here in san francisco towards the bay bridge on the embarcadero. we have meteorologist kyla grogan in the weather center with details on the fog there behind layer hanging out, but believe it or not, this is better than yesterday when we couldn't see any blue sky at this hours, though. >> we are getting some nice blue skies out there in a live look from the east bay kind of showing that mix of sun and clouds. but it should be a pretty nice day today. you can see temperatures right now in san francisco. still in the 50's, oakland's made it into the 60's. some nice 70's popping up in our inland spots from san jose to livermore concord, santa rosa, almost there at 69 degrees. and of course, half moon bay still dealing with the clouds at about 55 degrees right now. the other part of this story today, other than the marine layer is that we're really going to see this winds start to pick up as we get into the afternoon and the evening and frankly, even into the overnight hours, this is about 7.30. this is the gusty conditions you can see into the overnight hours. it really gets going. i think a bit more than we've seen yesterday. so just be prepared for that as you make your way out and about across some of the

bridges are probably going to feel that we get into the afternoon right now. you can see that we are catching a little bit of a break, but notice there is a system to our north that's bringing some rain to the pacific northwest. and zoom in here. you can see we could catch a few high clouds from that just a little bit as we go throughout the day today. so well that marine layer pulls away. a few high clouds are likely to roll by 2. so what that means is we're going get some really nice sunshine going, but then we'll start to see some of that wind picking up. and then, of course, you get to the evening will see that marine layer bill back, although have to say it doesn't look like it's going to build back quite as robust as it was the last 2 nights and mornings. here are the highs today. they will be pretty nice out there. so looking for upper 70's, low 80's inland. so nice 60's around the bay and 50's out at the coast. we've got a warm-up on the way. we'll talk about it when come back with your seven-day forecast. i residents in the southern gaza city of rafah have not reported an escalation in fighting as israeli forces pressed their assault on that border town. israel says it is

carrying out. >> limited operations in eastern rafah along the gaza, egypt border as the u.s. and other allies of israel have warned against a full-fledged attack on hamas in that city and in the east bay organizations calling for a cease-fire, put together this vigil at the lake merritt amphitheater in oakland. last night's event was called all eyes on rafah. >> and according to the gaza health ministry and the palestinian red crescent rescue service, at least 45 people were killed after that israeli airstrike. the health ministry does not to different differentiate between civilians and combatants. 2 of those killed are said to be hamas terrorists. a white house national security spokesperson says israel has a right to go after hamas, but they must take every precaution possible to protect civilians. israel's prime minister is calling this a tragic mistake and says an investigation is now underway. >> the details of yesterday incident are still on their

>> concord, police responded to 2 separate barricade situations within minutes from each other. police. >> have now detained people from both incidents across 4. sarah stinson has the details. >> a busy night for concord police. 2 separate scenes with a barricaded suspect here on saint francis drive. a shelter-in-place has been lifted but investigators are still trying to figure out what happened here on rose brook court. police got called to a home here just off of kowal road around 6 o'clock. police say a mom lives there with her 3 daughters and a neighbor came over armed with a gun, threatening them. the

family ran out of the home. they fully they are safe. they called police officers on scene. then heard gunshots coming from inside the home. that's when they put a shelter-in-place for people who live nearby. police were making a plan to get the man out safely when he came out on his own around 8 o'clock, he was armed with a gun. he was then brought into custody. i'm told the man arrested is 47 year-old christian stewart and police are trying to figure out what his motive was drugs and alcohol involved. meanwhile, officers were also at the scene of another barricaded suspect in an apartment complex on detroit avenue. this scene started around 3 o'clock in the afternoon when neighbors called police saying a man was screaming acting crazy with a blowtorch and waving knives around. police responded and learned the man had been evicted from this apartment a couple of weeks ago and he returned and broke into that unit. police spent hours with

a crisis negotiator trying to get him out. a police dog was used to get the man in custody. officers say he was bit by a dog around 8 o'clock tonight and brought to a hospital with minor injuries. police say 35 year-old ahmed davis will be booked into jail afterwards. we saw officers going door to door here on roseburg court, trying to talk with neighbors about what happened. police say a lot more to come with their investigation. i'm sara stinson reporting in concord kron. 4 news. developing now. police say at least 5 people including a teenager, were shot and sacramento. police say this happened. >> just after 8 last night in the neighborhood in south sacramento, officers are saying the victims were standing outside of an apartment complex when they were shot. officials do expect all the victims to survive. officers have not said what led up to the shooting. >> messages that that you saw something or heard something to please let us know, help us find the individuals responsible for this. there's a lot of people that were involved in the shooting. we're not sure of all the facts circ*mstances

surrounding this incident, what led up to the shooting. but there are a lot of people that were injured in this and we need to make sure that they receive justice. police say one of the shooting victims is a teenage girl. the others, 3 men and a woman. we will continue to follow the story and soon as we get more information. >> we'll bring it to here. you can also get details on our website. kron 4 dot com. we're taking a live look outside in the east bay towards walnut creek. it's really nice and pleasant out there today. and it likely will be the coolest day of the week. let's get all those details right now from our meteorologist kyla grogan. hey there. yeah, because we do have a warm-up on the way. but right now some low pressure to the north of us kind of pressing that jet stream down a little bit and keeping a lid on temperatures. >> and keeping a lid on this ridge of high pressure that otherwise will be warming us up, which will start to feel tomorrow. but today we're already getting a little bit of an earlier break from the marine layer. you can see here on storm tracker. 4 are looking pretty good. still some clouds certainly out at the coast, but even there it half moon bay, it's definitely a lot brighter. then. it was about an hour ago. so a little bit of sun breaking through

there. and you can see temperatures. 54 degrees in half moon bay, but we're warming up in places like fremont and san jose already in the low 70's concord. 73 61 in oakland, but we're at 70 in petaluma you can obviously the sun kind of breaking through starting to give us a pretty nice afternoon. the only caveat here is that the wind is going to keep picking up as we go throughout the afternoon. it is still a bit of that on shore flow. so just get ready for that. if you are out and about. but as we take a live look outside here in san francisco, you can see that sun is breaking through a really nice out there right now. nice mix sun and clouds. but as i mentioned, this wind will pick up. so while we're in, the teens now will likely be looking at you about 20 miles per hour as we work our way into the afternoon and evening. so if you're headed to see the giants taking on the phillies, it's at 06:45pm. tonight. first pitch about 59 degrees, breezy conditions. but got a sunny conditions. and then as we get into the evening, we'll have mostly clear skies. it is going to be a little bit of marine layer that rolls in, but it shouldn't be too bad. so it should be pretty nice evening

so tight. it's showroom. it's administrative offices. >> a warehouse and then a large lumber yard outside full of for what? so it burned for several hours. michael hunt with the oakland fire department says crews initially struggled gaining access to the lumber yard and the surrounding area property. >> sits the border. the borders are railroad we could put all we can bring was hose lines on the railroad track put water on one side of the property and the high street also borders. it's getting apparatus into the property was a challenge. fire crews were out on the scene all day monday working with the owners to go through the property for any additional hot spot excavation crews, the heavy equipment operators assistant picking apart the property and officially make sure that any flare ups are being quickly extinguished throughout the process. all of the parking structure that need to to be demolished last night. you know, there were several small recant goals which were

charge of overseeing the reparations process in the state of california. critically important. >> for setting up the framework for reparations going forward. i think we have a good foundation work from but several reparations related bills did not make it, including bradford's proposal to fund housing and property tax assistance for descendants of enslaved black americans. i disappointment reparations about. >> land. that's why we build generational wealth in this country african-americans have been denied ownership to redlining restrictive covenants, all kind of other restrictions not included in any of the reparations bills this year, direct cash payments. democratic leaders overseeing the state budget they would have liked to advance more reparations bills, but they add it just would have been too costly as the state faces a projected multibillion-dollar deficit. it's just a challenging budget time. and so we need to be responsible, responsible taxpayers money. so that's why we had to make some tough calls. and lawmakers whose reparations bill to not make it through this year. tell me they will try again in future

years reporting at the state capitol. eytan wallace kron. 4 news. >> a new ballot initiative, california businesses are trying to rein in government spending. the taxpayer protection act would make it more difficult for state and local lawmakers to raise taxes this ballot proposition would require two-thirds of voters to approve any city or state tax increase. but it is currently being challenged in california supreme court by governor gavin newsom. he wants the justices to kill this prop before it gets on the ballot. the state argues the proposition would deny the government the money it needs for public safety or fixing streets. but supporters are saying taxpayers are done getting steamrolled by sacramento. >> the taxpayer protection act ensures that all new taxes have broad support from californians by empowering voters. >> the state supreme court must rule in the next few

weeks. otherwise voters in november could send a message in california saying that they have had enough. it's rare for courts to intervene before a vote on a proposition that's already qualified for the ballot. opponents worry if past they won't be able to undo the damage. they believe this presents to city and state governments. and the south bay to san jose city council members are demanding the city audit its spending on homeless services. this is coming after a state audit found in april that the city spent more than 300 million dollars on its homeless response. the council members are saying they want to look at how much money is being divided into removing encampments and temporary housing. the california state auditor found the city could not identify the money. it spent on homeless support nor doesn't adequately measure the effectiveness of its systems. the report also says the city lacks enough in term or permanent housing to keep up with the demand. san jose has until september to begin publicly reporting data and

begin a plan. to figure out how they will address homelessness. >> i somebody whether open-ended that it needed that it said 40's and i where >> former oakland police chief leronne armstrong kicked off his campaign for city council and the clemens high school over the weekend. he was joined by a lineup of community leaders, including councilmember noel gallo. armstrong wants rebecca kaplan seat. he faces 8 other candidates there. armstrong is diving into politics while the same time suing oakland for wrongful termination. tonight, the berkeley city council is holding a special election for its district 4 seat, which covers downtown and central berkeley. this follows after kate harrison resigned in january saying processes are, quote, broken. harrison was first elected to the berkeley city council in 2017. she is currently running to be the city's mayor. 4 candidates won

her seat and we'll follow the story and let you know who is elected once the results are out. in the east bay, many families headed to the shore as the summer season. you know, it's officially has started now boating and jet skiing, a very popu ar. you'll see a lot of the happening of the pittsburgh marinas. the temperatures get hotter in the weeks to come and water. safety has been top of mind for many families under state law. children under 13 of age on a moving recreational vessel are required to wear a life jacket unless they're constrained by a harness, tethered to a sell boat or in an enclosed cabin. the u.s. coast guard also suggest voters plan ahead in case of emergencies. the family that we talked to say that they use signals to communicate with each other when they're in the water. >> you get tossed off. get to the side. you know, if if you need help. tap your had otherwise give a thumbs out. that's kind of our our family family rules of the jet ski in the boat.

actually catching a bit more of a break from the marine layer today. so far starting to get some nice warm temperatures out there, antioch already at 78 degrees. 75 in concord. 73 in san jose. certainly cooler around the bay were in the 60's and out of the coast in the 50's. but north bay starting to catch up to and kit those 70 degree mark. so temperatures over the next few days are actually going continue to warm and peak as we get into thursday and friday before they start to pull back. so we're looking at walnut creek as an example here today, looking out for at 76. but by thursday, 88 degrees possible for some of our inland spots. so well above average, when you consider we should be about 78 79 degrees. so while we do have the marine layer to contend with today, we will see things get a little more compacted tomorrow as we see that sunshine work its way in same story on your thursday when we get up to a very warm temperature profile were around the bay itself. we could look out for some even upper 70's and out of the coast 60's. i'll be back in a bit. we'll talk more about our 7 day forecast. as we continue

right now. you can see where the warmth is in the center of the state there in spots like bakersfield, fresno. >> and reading sitting in the 80's. well, we've got 60's along the coast. still some marine layer to contend with. this is a live look from our mount tam cam. you can make san francisco at your certainly aware tkat we've got some of that marine layer. but having said that, like nice blue skies as we take a look at san francisco. also some breezy conditions that are going to picking up as we get into the afternoon. we're at 59 degrees in san francisco, low 60's in oakland, but 70's are with us already. and many of our inland spots, half moon bay. little cool out of the coast. there sitting at 55 degrees. i mentioned a little breezy. you can certainly see it at point raise. but and as we head to the afternoon, we're going to see these numbers kind of push into the upper teens, even low 20's in some spots. stormtracker 4, though, showing how we're catching a little bit of a break today from the marine layer little bit quicker than we did yesterday, which means we get more sunshine a little bit longer. there is a little action to the north of us, but that stays away from us. we could see a few high clouds that rolled through from just

the tail end of that. but check out what happens in our fog cast as we get into the evening. notice really are not rebuilding quite as quickly. so it's not going to be quite as pronounced as it was this morning. and yesterday morning. in fact, this is 06:00am tomorrow and well. you certainly see some of those clouds along the coastline. you just don't see it quite as pervasive, which means that it will start to move away quicker. and we're going get that sunshiny even faster tomorrow, which of course, makes sense because we're going to be warming up that speaking of warming up now looking into next week, this is the extended forecast. you can see a good portion of the country expected to be above normal, including here in san francisco, right where we are going to see temperatures that above where they would normally be this time of year for the entire bay area. and that's again, june second through 6th, which hard to believe that june starts already. as we get into this weekend. so the warm-up is on the way and it looks like our warmer than average profile will stick with us. not just through this week, but into next week, although, you know, it's obviously going to cool
